US TOXIC SUBSTANCE CONTROL ACT (TSCA) AND CALIFORNIA PROPOSITION 65 (PROP 65)

SMART IN FLOW CONTROL

The Toxic Substance Control Act (TSCA) was passed in the US in 1976. The Frank R. Lautenberg Chemical Safety for the 21st Century Act passed in 2016 includes modernizations to TSCA. These special rules serve to implement occupational health protection, environment protection and climate protection.

Many countries across the world have adopted common rules on how to evaluate chemical substances and their mixtures. One of these systems is the United Nations Globally Harmonized System (GHS) of Classification and Labelling of Chemicals. TSCA also follows the UN GHS. SAMSON applies the GHS in line with the associated European requirements.

SAMSON does not see its supply chains to the US impacted at the moment. This statement is based on the information we currently have available. If required, we will notify our customers of suitable action to protect against such substances:
Our suppliers provide us with material safety data sheets (MSDS) for chemical substances and their mixtures. SAMSON reviews these safety data. Substance content calculations are based on every single product (such as bolt, nut) contained in a bill of materials. We review raw materials based on material data sheets. We are in close contact with our suppliers as part of this process.

California Proposition 65, formally titled The Safe Drinking Water and Toxic Enforcement Act of 1986, also referred to as Prop 65

We hereby confirm that SAMSON AKTIENGESELLSCHAFT is well informed of this law.

Prop 65 entered into force in California in 1986. Its intention is to protect drinking water sources from toxic chemical substances. At the moment, the law covers over 1000 substances known for their carcinogenicity, mutagenicity or reproductive toxicity. All products sold in California must come with warnings related to these substances or their mixtures as well as other contents.

The law mainly applies to consumer products. Consumer products are products intended for personal or household use.

SAMSON sells products for industrial use. Products for industrial use are normally mounted, operated, repaired, dismantled and scrapped by professionals.

According to the information we currently have, SAMSON AKTIENGESELLSCHAFT is not affected by this law as we are selling our products to industrial companies and not private consumers.

SAMSON AKTIENGESELLSCHAFT applies comparable legislation to minimize the environmental impact of our products. The California Office of Environmental Health Hazard Assessment cooperates closely with the European Chemicals Agency (ECHA).
